High court Judge- Jean Kaira has reserved her ruling to November, 18 this year on whether to dismiss an injunction in a matter in which the Malawi Local Government Association is challenging the redeployment of some district commissioners.
In court on Friday, Judge Kaira heard from Thabo Chakaka Nyirenda, the Attorney General that the complainants are being represented by an entity that is not legally recognized.
The court session that could be characterized by hot tempered counter arguments from both sides of the claimant and defendant, started at around 3 PM and ended at exactly 8:40 PM.
However in his counter argument, Davis Niobvu, Lawyer for MALGA told the court that the Association is a legitimate umbrella body for among others the district commissioners.
He since told the court that, the issue at hand goes beyond the redeployment to the independence of the local government in accordance with the principles of decentralization.
But still, earlier, Njobvu had applied for an amendment to the name of party which was granted by the judge.
Meanwhile, the high court judge has adjourned the case to November, 18 this year when she is expected to give her ruling on the application to dismiss the the injunction obtained by MALGA.
